Terms &
conditions.
These terms govern ticket sales for Us By Night and the rights and obligations of the visitor, the ticket distributor and the organiser. Reserving a ticket means you've read and accepted them.
These general terms of sale govern the ticket sale, the concluding of related agreements and the mutual rights and obligations of the purchaser/visitor, ticket distributor and organiser of the festival.
Purchaser / Visitor — the person in whose name a ticket is reserved or purchased, and/or the person who attends the festival.
Ticket Distributor — WEEZEVENT SAS, 14 rue de l'Est, 21000 Dijon, France.
Organiser — US BY NIGHT BV, Muntstraat 4, 2000 Antwerp.
These terms are an inherent part of the agreement that arises out of the purchase of one or more tickets. By reserving a ticket, the purchaser explicitly acknowledges having read and accepted them, as they are made available during the reservation process.
All reservations are made only after receipt of the required payment. The offer to reserve applies provided the stated payment period is respected — and this is applied strictly as an event or price category nears sold-out status.
The ticket distributor may, even in the event of late payment, still honour a reservation if supply for that price category permits. The person or company that makes a reservation is the customer and guarantees payment, even where the ticket is made out to or sent to a third party.
The right of cancellation does not apply: the service (the ticket reservation) is effected immediately and concerns leisure-activity services.
Any form of counterfeiting — including reprinting or faking, in any form or process — is strictly prohibited and will result in criminal prosecution.
Ticket buyers must comply with the Belgian Act regarding the Sale of Entrance Tickets to Events (Belgian Law Gazette, 30 July 2013). Regular or occasional resale above the original ticket price is prohibited. The ticket distributor may invalidate any resold ticket, and its holder may be refused access without any right to compensation.
Access is granted only to the first holder of the original ticket; holders of copied tickets will be refused admission. Tickets may not be used for commercial or promotional purposes, or made available to third parties, without express authorisation from the distributor or organiser. Identity checks may be carried out at any time.
Organising the festival — including the programme, dates and places of performances — is the responsibility of the organiser, to the exclusion of the ticket distributor, who is responsible only for ticket sales and related transactions.
Changes to the programme are not grounds for a refund, in whole or in part; the organiser's liability in such cases of force majeure is excluded. Tickets are not refunded or exchanged for another event. Loss or theft of a ticket is the visitor's responsibility and gives no right to replacement or refund.
Tickets are non-refundable and non-exchangeable. If the organiser cancels the event, the customer is not entitled to a refund or any additional compensation. Cancellation by the customer does not entitle them to a refund.
The following may not be brought onto the festival site, on penalty of confiscation by security:
- Drinks and cans.
- Laughing gas and drugs.
- Dangerous objects such as glassware, metal drinking bottles, filled bottles, fireworks, weapons, sharp objects, or anything else the organiser considers dangerous.
The organiser may amend or supplement this list at any time. Entering the site implies acceptance of all preventive and control measures, including possible frisking and bag searches; failure to respect them results in refused or withdrawn access, without compensation.
Official sale of T-shirts and souvenirs is confined to the festival site — any sale outside is unofficial and may be counterfeit. TV recordings and drones operate on and around the grounds, so visitors may be filmed; by entering, you waive your portrait rights and accept being an involved party.
Promotional or commercial activity at the festival without prior permission is forbidden, as is any commercial use of the name or logo of the festival or its artists without written authorisation. The organiser and/or distributor cannot be held liable for any damage, loss or theft suffered on the site, outside it, or on the way.
Cashless payments
When purchasing UBN Tokens, the buyer agrees to the organiser's current Cashless Payments terms. These are also available at the counters and cashless help desks at the festival; a first physical top-up also constitutes acceptance. The organiser is supported by external suppliers and payment providers.
General
Payments at the festival are cashless. The organiser may also allow other payment methods for practical reasons without prior notice. UBN Token is the official currency: buyers top up online via their Cashless Account or at a counter, then pay through a cashless medium (a tag on the official wristband, or a cashless card). The value of one token is communicated when tokens go on sale. The organiser cannot be held liable if the cashless system fails or works only partially, and does not issue detailed invoices for individual token spending.
Disputes over transactions
Problems with top-ups or transactions should be reported as soon as possible to the cashless help desk at the festival or to cashless@usbynight.be. The organiser may reject complaints without supporting evidence, and is not liable for theft or loss of the cashless medium — report any loss immediately.
Refunds
Except for tokens granted for free (never refundable), UBN Tokens can be refunded after the festival ends. Barring force majeure, refunds requested on time are made within 30 days. A refund fee applies, communicated when tokens go on sale; free tokens cannot be used to pay it. Refunds are requested via the form in the Cashless Account, within the organiser's deadline; late requests aren't considered, and the buyer is responsible for providing correct refund details.
Disputes about orders must be sent to the ticket distributor by registered mail within eight days of receiving the request for payment. Other disputes about ticket sales must be reported within a reasonable period, at most thirty days after the dispute arises.
For cross-border consumer disputes, the ticket distributor points to the European Consumer Centres Network (ECC-Net), reachable at eccnet.eu. These terms — and any disputes relating to them — are governed exclusively by Belgian law.
